1. PRACTICE OVERVIEW

SB Adult Health Nurse Practitioner PLLC is a New York professional limited liability company providing cash-based, mobile concierge-style wellness and telehealth services delivered by a New York-licensed Nurse Practitioner.

Services may include, but are not limited to:

Wellness consultations

Preventive care services

Mobile visits

IV hydration therapy

Injectable wellness therapies

Weight management services

Telehealth visits

All services are elective, non-emergency, and self-pay unless otherwise stated.

2. NOT A SUBSTITUTE FOR EMERGENCY CARE

Our services are not emergency medical services.

If you are experiencing chest pain, shortness of breath, loss of consciousness, severe pain, signs of a stroke or heart attack, or if you experience a life-threatening episode, please call 911 or go to the nearest emergency department immediately.

3. MEDICAL DECISION-MAKING & SCOPE OF CARE

All medical services are provided at the sole clinical discretion of the Nurse Practitioner.

Completion of intake forms does not guarantee eligibility.

Services may be refused or discontinued if deemed medically inappropriate, as we reserve the right to modify, delay, or cancel services for patient safety concerns.

4. NO GUARANTEES OR PROMISES

We do not guarantee results, symptom resolution, prevention of illness, cosmetic or performance outcomes as individual responses to wellness services vary.

5. CASH-BASED PRACTICE & NO INSURANCE BILLING

We operate as a cash-based medical practice.

We do not bill insurance, Medicare, or Medicaid.

Clients are responsible for full payment before the service is rendered.

Superbills may be provided at our discretion, but reimbursement is not guaranteed.

6. PAYMENT, FEES & REFUNDS

All prices are disclosed before service and payment is required before services are rendered.

Membership fees, retainers, and deposits are non-refundable unless stated otherwise.

Missed appointments, late cancellations, or no-shows may result in forfeiture of fees and/or additional charges.

7. APPOINTMENTS & CANCELLATIONS

Cancellation policies vary by service type, unless otherwise stated.

Cancellations must be made 24 hours in advance.

Same-day cancellations may incur a fee, typically $25.

The provider may cancel appointments to ensure safety due to any acute illness or unforeseen circumstances.

8. MEDICAL WEIGHT MANAGEMENT

Medical weight management services are provided following a comprehensive clinical assessment and may include prescription therapy when medically indicated.

Initiation, continuation, or discontinuation of treatment is determined solely by the Provider based on safety, response, and adherence.

No specific outcomes or weight loss results are guaranteed.

9. TELEHEALTH SERVICES

Telehealth services are subject to technology limitations, internet connectivity, and state licensure requirements.

Telehealth is only provided to clients physically located in New York State at the time of service unless otherwise permitted by law.

10. IV HYDRATION & INJECTABLE SERVICES

IV hydration and injectable services are elective wellness services.

These services require medical screening and informed consent.

IV hydration and injectable vitamins may carry risks, including bruising, infection, vein irritation, allergic reactions, or dizziness.

You acknowledge that these services are not FDA-approved treatments for diseases, and outcomes cannot be predicted.

You are responsible for following post-service instructions given after services are rendered.

11. CLIENT RESPONSIBILITIES

Before the appointment, the client must provide an accurate and complete medical history, disclosing current medications, allergies, and any relevant medical conditions.

The client is responsible for following post-treatment instructions and informing us of adverse reactions.

Failure to provide accurate information may result in the refusal of services.

12. PROFESSIONAL RELATIONSHIP

Your relationship with this Practice does not establish a primary care relationship unless explicitly stated.

This practice does not replace your primary care provider and may be limited to services you elect to receive.

13. THIRD-PARTY LOCATIONS & EVENTS

When services are provided at gyms, events, hotels, and private residences, the Practice is not responsible for environmental hazards, non-medical incidents, or actions of third parties.

14. INTELLECTUAL PROPERTY

All content, branding, protocols, logos, educational materials, and website content are the exclusive property of SB Adult Health Nurse Practitioner PLLC.

Unauthorized use is prohibited.

15. PRIVACY & HIPAA

We comply with HIPAA and New York privacy laws.

Protected Health Information (PHI) is stored securely and used only for treatment, payment, and operations.

PHI is only disclosed as permitted by law.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Practice shall not be liable for indirect, incidental, or consequential damages.

Liability is limited to the amount paid for services rendered.

17. INDEMNIFICATION

You agree to indemnify and hold harmless the Practice from claims arising from false or incomplete medical disclosures, failure to follow instructions, or misuse of services.

18. TERMINATION OF SERVICES

We reserve the right to terminate services if there is non-compliance with the treatment plan, payment obligations are unmet, or if continued care is deemed unsafe or inappropriate.

19. MODIFICATIONS

We reserve the right to modify these Terms & Conditions at any time and you will not be updated.

Updated versions will be posted on the website and will become effective immediately upon publication.

20. GOVERNING LAW & JURISDICTION

The laws of the State of New York govern these Terms & Conditions.

Any disputes shall be exclusively resolved in Queens County, New York courts.

21. ACKNOWLEDGMENT

By using our services, booking appointments, or signing electronically, you acknowledge that you have read, understand, and agree to these Terms & Conditions.

22. GENERAL MEDICAL DISCLAIMER

Services provided are for wellness, preventive, and non-emergency medical care and do not replace the need for emergency or hospital-based treatment.

All care is individualized and provided based on a review of medical history, clinical assessment, and professional judgment; outcomes cannot be guaranteed.

Clients are responsible for providing complete and accurate health information and for seeking emergency care when medically necessary.

The provider reserves the right to modify, decline, or discontinue services when clinically appropriate or required for patient safety.

23. MEDIA CONSENT

From time to time, photographs or video recordings may be taken for educational, marketing, or promotional purposes.

I understand that participation in photography or video recording is completely voluntary and not required to receive services.

If I choose to grant permission, I authorize SB Adult Health Nurse Practitioner PLLC, DBA The Modern Nurse Practitioner in Adult Health, to use images or recordings in which I may appear for marketing, educational, or promotional purposes, including on websites, social media, or printed materials, without compensation.

I also understand that no protected health information will be disclosed and that I may decline or revoke this authorization at any time by notifying the practice in writing.
